Terms of Service

Terms governing the supply of Wildeye hardware and access to the Wildeye cloud platform.

A Wildeye deployment is two things under one agreement: hardware you buy once, and a cloud platform you subscribe to per device. The terms below are organised around that split, because the commitments differ. A logger in a flooded pit is a product. The dashboard is a service.

The binding Terms are being finalised. Rather than publish nothing, the outline below sets out exactly what each section will govern. For the current draft, a master service agreement, or procurement paperwork, email legal@mywildeye.com.

Acceptance

Covers when these terms take effect and who they bind: the organisation named on the order, not the individual who clicks. It will also cover how changes to the terms are notified and what happens if you do not accept them.

The service

Covers what is being supplied and where the boundary sits. The cloud platform is what Wildeye commits to; the carrier network the loggers ride on is not ours and cannot be guaranteed. This section will draw that line explicitly, along with what the per-device subscription includes.

Accounts

Covers user accounts, roles and permissions, responsibility for credentials, and how access is granted to third parties such as agronomists, contractors or consultants who need to see a customer's sites.

Fees & payment

Covers the two charges (one-time hardware and the recurring per-device platform fee), invoicing and terms, what happens when a fleet grows mid-period, and the commercial position already published on our pricing page: no setup fees, no gateway charges, no per-data charges.

Data ownership

Covers the point that matters most to operators: your readings are yours. This section will confirm that, set out the licence Wildeye needs to operate the platform on your behalf, and state that export in standard formats is available at any time.

Acceptable use

Covers reasonable use of the platform and the API: rate limits, resale or redistribution of the service, and security testing (which we welcome under responsible disclosure).

Availability

Covers the availability commitment for the cloud platform, planned-maintenance notice, and how incidents are communicated. It will restate the boundary from “The service”: cellular coverage and carrier outages sit outside Wildeye's control, and buffered readings backfill when a device reconnects.

Liability

Covers warranty on hardware, the limits of liability, and the exclusions. One matters to anyone monitoring critical infrastructure: Wildeye reports what its sensors measure and is not a substitute for a customer's own safety, compliance or dam-integrity obligations.

Termination

Covers notice periods on either side, what happens to devices already in the field, and the documented data-export and deletion path that closure triggers.

Governing law

Covers the governing jurisdiction and how disputes are handled. Wildeye contracts from Australia and supplies customers in Australia, New Zealand and the United States; this section will state which law applies to each.
